Harley-Davidson Recall of Over 40,000 Motorcycles: What You Need to Know

Motorcycle enthusiasts often gravitate towards Harley-Davidson, a brand synonymous with American culture, high performance, and iconic designs. However, a couple of weeks ago, Harley-Davidson issued a significant recall that affected over 40,000 motorcycles in the U.S. market. This recall, which addresses a potentially defective voltage output wire issue causing the unexpected loss of drive power and electrical power, serves as a crucial reminder that even established and reliable brands can release defective products that may pose serious risks to riders.

As a consumer, it’s essential to understand the details of this recall, how it was handled by Harley-Davidson and the National Highway Traffic Safety Administration (NHTSA), and how this situation fits into a broader context of product defects, safety, and liability.

Details of the Harley-Davidson Recall

The Nature of the Recall

On September 16, 2024, Harley-Davidson announced a recall involving over 40,000 of their motorcycles due to a potentially serious issue. Harley-Davidson Motor Company (Harley-Davidson) is recalling certain 2024 FLHX, FLHXSE, FLTRX, FLTRXSE, and FLTRXSTSE motorcycles. The voltage regulator output wire may rub on the front corner of the crankcase, exposing the wire and causing an electrical short circuit. A short can result in a loss of electrical power and drive power, which increases the risk of a crash.

Remedy

Dealers will inspect and as necessary, repair the voltage regulator output wire harness, and install a secondary retention strap, free of charge. Owner notification letters were mailed on September 23, 2024. Owners may contact Harley-Davidson customer service at 1-800-258-2464. NHTSA Campaign Number: 24V672000.

Notes

Owners may also contact the National Highway Traffic Safety Administration Vehicle Safety Hotline at 1-888-327-4236 (TTY 1-800-424-9153), or go to www.nhtsa.gov.

How the Harley-Davidson Recall Was Issued

The recall process began with reports submitted to the National Highway Traffic Safety Administration (NHTSA). Harley-Davidson investigated the issue, determining that a defect existed, and subsequently worked closely with the NHTSA to announce a recall. This coordination ensured that affected motorcycles could be identified, and owners could be notified promptly. The NHTSA oversees safety recalls and works with manufacturers like Harley-Davidson to ensure that any products presenting an unreasonable safety risk are addressed as quickly as possible.

Upon discovery of the defect, Harley-Davidson communicated with both its dealer network and registered owners of the affected motorcycles. Owners were advised to stop riding their motorcycles immediately until a dealer could inspect and repair the issue. Harley-Davidson also promised to perform all necessary repairs free of charge.

A Defective Product and Potential Dangers for Riders

The Link Between Defective Products and Accidents

This Harley-Davidson recall is a textbook example of how defective products can pose serious risks to consumers. Motorcycles, by their very nature, require high levels of safety to ensure riders can navigate roads and traffic safely. A faulty brake system, especially one prone to leaking fluid, can severely impair the stopping ability of a motorcycle, placing both the rider and others on the road in danger.

In the event of a loss of drive or electrical power, a rider may suddenly slow down or stop. This can lead to severe motorcycle accidents, including rear-end collisions, single-vehicle crashes, and intersection-related accidents. The nature of motorcycle crashes often results in more serious injuries or fatalities than those involving cars or trucks, due to the lack of protection for the rider.

Possible Injuries from Motorcycle Accidents

Motorcycle accidents can lead to a wide range of injuries, including:

  • Head and Brain Injuries: Even with helmets, motorcyclists can suffer from concussions, traumatic brain injuries (TBI), and skull fractures.
  • Spinal Cord Injuries: A crash can result in serious spinal injuries that may lead to paralysis or other life-altering disabilities.
  • Fractures and Broken Bones: Arms, legs, ribs, and other bones are vulnerable to breakage upon impact.
  • Road Rash and Burns: Sliding along pavement can result in severe abrasions, burns, and infections.

The severity of these injuries often requires extensive medical treatment, rehabilitation, and, in some cases, lifelong care. Unfortunately, some accidents are so severe that they result in the wrongful death of the rider or passengers.

How Defective Products Contribute to Injury and Wrongful Death Lawsuits

Manufacturers like Harley-Davidson have a legal duty to produce safe products and to address any defects that may arise after products have been released to the market. When they fail in this duty, and the defective product leads to injury or death, the manufacturer may be held liable through product liability lawsuits.

For individuals injured in motorcycle accidents caused by defective parts, there are generally three types of product liability claims that may be pursued:

  • Design Defects: If the product’s design is inherently dangerous, it can result in injuries even when used as intended.
  • Manufacturing Defects: These occur when a product is incorrectly manufactured, departing from its intended design, which renders it unsafe.
  • Failure to Warn or Instruct: If the manufacturer fails to provide adequate warnings about the risks associated with using the product, they may be held liable for any resulting injuries.

In the case of the Harley-Davidson recall, it is evident that the voltage output wire issue falls under a potential manufacturing defect. This defect presents a clear safety hazard, which can contribute to accidents that cause injuries or fatalities. Injured riders and their families may be entitled to compensation for medical expenses, lost wages, pain and suffering, and in the tragic event of death, wrongful death damages.
